Terms of service

These Terms of Service ("Terms") govern access to and use of infinitechat.ai and InfiniteChat products and services (the "Services"). By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree, do not use the Services. Our Privacy Policy explains how we handle personal information.

InfiniteChat provides software for social media automation, AI chat agents, related integrations, and associated websites and documentation. Features may evolve over time. Beta or preview features are provided as-is and may change or be discontinued without notice.

• You must provide accurate registration information and keep it up to date
• You are responsible for safeguarding credentials and for all activity under your account
• Notify us promptly of any unauthorized access or security incident
• You must be legally able to enter a binding contract in your jurisdiction
• The Services are intended for business and professional use

You retain ownership of content, data, and materials you submit to the Services ("Customer Content"), including agent prompts, knowledge bases, contact lists, and conversation data you control. You grant InfiniteChat a limited license to host, process, transmit, and display Customer Content solely to provide and secure the Services.

You represent that you have all rights and consents needed to upload and process Customer Content, including personal data of end users, and that your use complies with applicable privacy and marketing laws.

You agree not to:

• Use the Services for unlawful, fraudulent, harassing, or deceptive activity
• Send spam or unsolicited communications in violation of applicable law
• Violate messaging consent, spam, or Do-Not-Contact rules applicable to your channels
• Infringe intellectual property, privacy, or other rights of third parties
• Attempt to reverse engineer, probe, or disrupt the Services or related systems
• Bypass usage limits, security controls, or access restrictions
• Upload malware or content that is illegal or harmful
• Misrepresent AI-generated communications as human where disclosure is required by law

We may suspend or terminate access for violations of these Terms or for risk to the platform, users, or third parties.

The Services may generate automated text, recommendations, or actions. AI outputs can be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing outputs before relying on them in production, customer-facing, or regulated contexts.

The Services may integrate with third-party platforms (for example social networks, CRMs, messaging providers, or payment processors). Your use of those services is subject to their terms and privacy policies. InfiniteChat is not responsible for third-party services or for changes that affect integrations.

• Fees are based on your plan and usage (including chat sessions and seats as applicable)
• Unless otherwise stated, fees are non-refundable except where required by law
• You authorize us (and our payment processors) to charge applicable amounts
• Taxes may apply in addition to listed prices
• We may change pricing with notice for renewing or future billing periods

InfiniteChat and its licensors own the Services, software, branding, and documentation. These Terms do not grant you any ownership rights in InfiniteChat intellectual property. Feedback you provide may be used by us without obligation.

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect that information and use it only for purposes related to these Terms, except where disclosure is required by law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINITECHAT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFINITECHAT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO INFINITECHAT FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You will defend and indemnify InfiniteChat against claims arising from Customer Content, your use of the Services, or your violation of these Terms or applicable law, except to the extent caused by InfiniteChat's willful misconduct.

You may stop using the Services at any time. We may suspend or terminate access for non-payment, material breach, legal risk, or prolonged inactivity. Upon termination, your right to use the Services ends. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive.

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless a different governing law is required by mandatory local rules or agreed in a separate enterprise agreement. Courts in Bengaluru, Karnataka shall have exclusive jurisdiction, subject to applicable consumer or mandatory protections.

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms, except where additional consent is required by law.
